This protocol develops the rules that are the main core of the activity that the Oversight, Monitoring and Verification Mechanism (hereinafter Mechanism or MVMV) will have and that will be applicable to the parties that are in compliance with the CFBTNT Agreement.
These rules and commitments are framed within:
• Respect life in all its forms, nature in all its aspects and the rights and freedoms of the civilian population.
• Avoidance of the humanitarian impact on the population in general and in particular on ethnic-territorial communities, peasants and other groups requiring special protection.
• To maintain the mobility of the Central General Staff of the FARC-EP in the defined geographical areas agreed between the parties through the Protocol on Areas of Presence of the Members of the Central General Staff of the FARC-EP;
to promote territorial transformations and the tasks of the MVMV during the construction of Peace.
• The Public Force will continue to fulfil its constitutional and legal mission throughout the national territory, in accordance with the Social Rule of Law, within the framework of the Ceasefire Agreement and its respective protocols.
• Avoid offensive actions and armed incidents between the Public Forces and the Central General Staff of the FARC-EP.
• Avoid situations that jeopardise compliance with the Bilateral and Temporary Ceasefire of a National character with Territorial Impact agreement (CFBTNT).
• An MVMV will be established, whose main function will be to verify compliance with the agreed protocols, consolidate information regarding possible offensive military operations, special operations by the National Police, offensive actions by the Central General Staff of the FARC-EP, and incidents that may be classified as breaches of prohibited acts;
and likewise, to draw up the corresponding reports.
• The parties commit to processing and verifying through the MVMV any situation that could be considered a possible incident or breach affecting the Bilateral, Temporary Ceasefire of a National Character with Territorial Impact (CFBTNT), before using the media or social media to make it known to the general public.
The Peace Dialogues Table will issue the corresponding joint statements.
The National Government and the Central General Staff of the FARC-EP, from the signing of this protocol, undertake to:
1. Not affect the rights and freedoms of the civilian population.
2. Not to carry out acts of violence or discrimination against the civilian population, including those based on gender, ethnic, religious or political grounds.
