Colombian Conflict (1964 - )
The Colombian conflict is really a set of conflicts and the peace agreements reflect both different processes relating to different conflict groups and dyads, and processes taking place at different times in a complex peace process history. The Colombian civil war has its roots in the late 1940s and the violent infighting between liberal and the conservative factions. Emerging from the liberal tradition with a thorough grounding in nationalist communist ideology, the Revolutionary Armed Forces of Colombia—People's Army (FARC) began its armed insurrection against the Colombian government in 1964. Other left-wing guerrillas emerged as well, most notably the socialist/populist M-19, which would later be integrated into the formal political system in the peace process of 1990s; the National Liberation Army (ELN), which has strong roots in liberation theology, and the Maoist Ejército Popular de Liberación (EPL) (also part of the 1990 process, less successfully). Several stages of peace processes were undertaken by the various sides, which were further complicated by the emergence of right-wing paramilitary ‘self-defence’ forces. The peace agreement between the Colombian government under President Uribe and the main alliance of the paramilitary groups, the United Self-Defence Forces of Colombia (AUC), concluded in 2005 and is still heavily disputed as several remnants are still active, but now subsumed under the heading ‘Bacrim’ (Bandas criminales). In addition, FARC and ELN maintain a military presence, but both demonstrate a strong interest in completing successful peace negotiations with the government, with the most recent agreements being between FARC and the Government.

The delegations of the National Government and Southern Comuneros, recognising the best interests of the child and that their rights are paramount, in accordance with international law and the constitutional mandate, and that they must be protected and guaranteed by the State, society and the family, hereby sign this Agreement with the aim of promoting effective and comprehensive actions aimed at mitigating the risks faced by this population, establishing priority routes for guaranteeing their rights, and ensuring their protection in the process of Co-Construction of Territorial Peace.

The Roundtable for Co-Construction of Territorial Peace in Nariño recognises that children and adolescents have suffered disproportionately from the effects of armed conflict.

Their fundamental rights to human dignity, family life, education, health, culture, participation, security, personal integrity, recreation and peace have been repeatedly violated.

An example of this is that in the department of Nariño, there are problems of orphanhood, poverty, family breakdown, school dropouts, violence and recruitment, among other violations that jeopardise the comprehensive development of this population and constitute forms of violence that are exacerbated by the presence of armed groups and organisations.

The impact of war on children and adolescents has a significant effect on the social fabric, requiring the restoration of their rights in dignified and safe conditions.

Furthermore, the ethnic and cultural diversity of the department of Nariño requires that the rights of children and adolescents be guaranteed with full respect for their cultural identity, customs and traditions, with a community-based, territorial, differential and intersectional approach, as well as for their right to their own education or ethno-education.

1. Commitments of the National Government

The National Government, through the Colombian Institute of Family Welfare (ICBF), undertakes to carry out a comprehensive characterisation process of the population of children and adolescents in the municipalities of Andes Sotomayor, Barbacoas, Cumbal, Guachucal, La Llanada, Mallama, Providencia, Ricuarte, Samaniego and Santa Cruz de Guachavés.

This characterisation will aim to identify the current situation of the rights of this population, the specific risks they face in contexts of violence and coexistence with armed actors, in order to implement priority routes for the comprehensive protection of their rights.

Children and adolescents who are relatives of members of the Southern Comuneros, within the framework of this group's transition to full citizenship, will be guaranteed their right to family life, as well as the full enjoyment of all their rights.

2. Commitments of Southern Comuneros

Southern Comuneros undertakes to refrain from any conduct that jeopardises the rights of children and adolescents, meaning anyone under the age of 18.

Likewise, it will promote respect for the rights of this population in the areas where it is present and will collaborate in the implementation of the routes for the comprehensive protection of their rights agreed upon in the framework of this Agreement.

The collaboration of Southern Comuneros will be subject to its capacities and the progress made in implementing the justice model, and under no circumstances will it affect the processes of transition to full citizenship.

Similarly, Southern Comuneros undertakes to provide information, within the framework of the Technical Subcommittee for the Protection of the Rights of Children and Adolescents, on situations of risk that it is aware of with regard to this population.

The confidential and extrajudicial information provided will be intended solely for comprehensive characterisation and the establishment of pathways for comprehensive protection, and to that extent may not be used for other purposes such as intelligence work or prosecution.

3. Establishment of the Technical Subcommittee for the Protection of the Rights of Children and Adolescents - ‘Subcommittee on Children’

In order to carry out a comprehensive characterisation of the population of children and adolescents for the implementation of priority routes for the comprehensive protection of their rights, a Technical Subcommittee for the Protection of the Rights of Children and Adolescents will be formed, composed of delegates from the National Government, Southern Comuneros, and the team designated by the ICBF, and open to the participation of the accompaniers of the Roundtable for Territorial Peace Co-Construction in Nariño.

The Ombudsman's Office will be invited to the Subcommittee.

The main task of the subcommittee on children will be to jointly establish the social interventions necessary to guarantee the rights of children and adolescents to a life full of opportunities and in a peaceful environment.

To this end, it will begin by conducting an assessment of opportunities and the situation of children's and adolescents' rights in the municipalities covered by this agreement and will establish this assessment as the baseline for a collective roadmap for children, from conception to the age of 18.

The subcommittee on children will define the protocols, strategies, community work methodologies, plans, and actions necessary for the development of the characterisation process, as well as the priority routes for the comprehensive protection of children and adolescents.

The subcommittee on children will invite officials, authorities, and traditional authorities of indigenous peoples, community councils, and peasant associations that it considers relevant to the fulfilment of its objectives.

The subcommittee on children will also establish specific conditions to guarantee the rights of children and adolescents who are relatives of members of the Southern Comuneros, within the framework of this group's transition to full citizenship and the right of all children and adolescents to live with their families and have their rights guaranteed.

The subcommittee on children will submit a preliminary report to the Roundtable for Territorial Peace Co-Construction within ninety (90) days of the signing of this Agreement, which will include initial findings, identified needs, and proposals for priority intervention.

Based on the preliminary report, a timeline will be defined for the characterisation, as well as differentiated routes within the framework of the comprehensive protection of the rights of children and adolescents in the identified municipalities.

The delegations of the National Government and Southern Comuneros, as well as the Episcopal Conference of Colombia, will contribute the information they have available to the process of characterising children and adolescents, in order to guarantee, protect and restore their rights.

The Roundtable for Territorial Peace Co-Construction in Nariño will monitor the functioning and development of the Subcommittee.
