AGREEMENT TO GUARANTEE CITIZEN, SOCIAL AND PEOPLES' PARTICIPATION IN THE PEACE PROCESS BETWEEN THE NATIONAL GOVERNMENT AND THE GENERAL STAFF OF THE BLOCS COMMANDER JORGE SUÁREZ BRICEÑO, MAGDALENA MEDIO- COMMANDER GENTIL DUARTE AND FRONT COMMANDER RAÚL REYES FARC-EP.
The National Government of the Republic of Colombia and the General Staff of the Bloc Commander Jorge Suárez Briceño, Magdalena Medio Commander Gentil Duarte and the Front Raúl Reyes FARC-EP, reiterate their conviction to advance in the participatory construction of a Peace Agreement, which puts an end to the armed confrontation and tends towards the achievement of a comprehensive, stable and lasting Peace with Social and Environmental Justice.
This agreement on participation is based on peace as a right developed in articles 2 and 22 of the Political Constitution, as well as article 8 C of Law 2272 of 2022 and incorporates the criteria and guidelines on participation that have been approved in the Agreements and Protocols signed since the installation of the Peace Dialogues Table -MDP- on last 16 October 2023 in Tibú.
In addition, the Protocol on Participation is governed by this Agreement and develops directives and guidelines for the participatory process.
The Peace Dialogues Table - MDP-, identifies the need to carry out actions of territorial transformation and in development of the contents of the agenda of the 10 axes agreed in the MDP in the cycle V in July 2024, to guarantee with all the actors of the society and in the short term to design and initiate its implementation, placing the communities at its centre.
Likewise, participation in the processes defined by the Peace Dialogues Table includes all the dimensions of the Agreements and Commitments that allow progress towards the construction of an agreement to end the armed conflict and the Transformations necessary for Peace with social and environmental Justice.
Definition and Objective of participation in the MDP
Participation is conceived as the mechanism through which communities and sectors of civil society, duly convened by the Peace Dialogues Table, contribute to the construction of the Final Peace Agreement between the National Government and the General Staff of the blocs Commander Jorge Suárez Briceño, Magdalena Medio Commander Gentil Duarte and the Commander Raúl Reyes front of the FARC-EP.
According to this Agreement, the participation of the communities is essential and decisive for the diagnosis, formulation and implementation of actions for peace within the framework of the Peace Dialogues Table, as well as in the definition and execution of the axes of the Agenda for the construction of the Peace Agreement, Special Agreements for Immediate Implementation, of a humanitarian nature within the framework of the IHL and human rights, of territorial transformations and of economies classified as illicit in special zones agreed at the Roundtable.
Scope and basic conditions.
The participatory construction of the Agenda for Immediate Implementation Actions and the Peace Agreement is carried out within the framework of the Political Constitution of Colombia and the Agreements reached.
The Constitution defines Peace as a right and a duty of obligatory compliance and establishes the scope, limits and procedures for institutional changes and economic, social, cultural and environmental transformations, in democratic rights and in the configuration of institutions and public powers.
Social, citizen and community participation will be carried out at the national, regional and local levels, giving priority to the territories in which the presence of the structures of the General Staff of the blocs Commander Jorge Suárez Briceño, Magdalena Medio Commander Gentil Duarte and the front Commander Raúl Reyes of the FARC-EP has been identified, without excluding other areas agreed at the Peace Dialogues Table.
In order for free and effective participation to be possible, basic conditions of de-escalation of various forms of violence, compliance with the norms of IHL and the commitments to Ceasefire and Respect for the Civilian Population that appear in the Agreements and Protocols signed at the Table of Peace Dialogues are required.
The spaces for participation will seek to contribute to gaining the necessary conditions for national political debate in order to build a great National Agreement for Peace with social and environmental justice.
Principles for participation
The parties envisage a participation process based on the following principles:
Pluralism: guarantee the active participation of organisations representing different sectors of society without exclusion for political, economic, religious, ethnic, gender or sexual orientation reasons. All persons and representatives of the different sectors of civil society will have a voice in the spaces for participation in the MDP. Grassroots social organisations, victims of the conflict, indigenous peoples, communities of black, Afro-Colombian, Afro-Colombian, Raizal, Palenquero, Rrom, peasant, women, youth, entrepreneurs, churches, representatives of political parties, academics, peace signatories, other community organisations and other groups with special constitutional protection will participate in a special way.
Respect: In all scenarios of participation in the MDP, all people and the diversity of ideas will be respected. Likewise, the content established in the document on the rules and functioning of the Roundtable will be applied in terms of the minimum requirements for dialogue.
Effectiveness and binding: the MDP Agreements are binding. In the scenarios arranged by the Roundtable and government entities, the decisions adopted as Special or Partial Agreements for Immediate Execution must address and include actions and work plans for their definition and implementation.
The commitment of the parties is to materialise what has been agreed, taking as a basis the guidelines emanating from the participatory spaces.
In accordance with paragraph 7 of Article 5 of Law 2272 of 2022, ‘the partial agreements will have to comply in all circumstances with the constitutional duties of the State or with the Laws in force and will be binding as long as they are in accordance with these precepts’.
Relevance: participation must correspond to the objectives of each event, transformation zone or thematic Axis of the Agenda for the Construction of the Peace Agreement.
Autonomy:
the sectors that participate do so from within their organisation, representation, autonomy and freedom of expression.
Information:
for effective and efficient participation before, during and after the event, all those convened must have timely, relevant and sufficient information about the issues to be addressed.
Security: in the participation scenarios, legal and physical security conditions must exist from the convening of the meeting to the monitoring and evaluation stages. This includes people, facilities, travel and the respective authorisations by the Peace Commissioner Advisor.
The national Government will provide the necessary legal and security guarantees for the communities, social organisations and public authorities that participate in the Peace Process guided by the Roundtable, the Office of the Peace Commissioner Adviser will carry out the relevant procedures to this end.
To this end, in addition to the Ceasefire that continues between the parties, mechanisms will be defined that enable the provision of guarantees for all participating actors, especially in areas of critical presence and confrontation between the different armed groups.
Participation approaches
In accordance with the Agreements signed and criteria that have been developed, the following approaches will be taken as a basis:
Territorial: the territorial approach recognises that there are regions or geostrategic zones with common and cultural assets, wisdom and mobility routes that give rise to different socio-environmental relations and contexts and interests over lands and territory, where different social sectors interact.
To this end, methodologies that respond to the socio-territorial dynamics of the regions must be applied.
This approach seeks to ensure their lasting permanence in these spaces, guaranteeing the physical, cultural and spiritual survival of these communities.
Ethnic approach: recognises ethnic peoples and communities as subjects of special protection, their territories, their ways of life and organisational forms.
It promotes respect for the collective, community, spiritual and cultural vision, as well as for life and ethno-development plans.
Also, to align with their traditional forms and mechanisms of protection and self-protection.
The ethnic approach demands guaranteeing the broad participation of indigenous, Rrom, black, raizal and palenquero peoples, taking into account the right to prior, free and informed consultation, the special consultation mechanism, consent and cultural objection.
Peasant approach: recognises peasants in their economic, territorial, social, cultural, political and environmental dimension, guaranteeing the special protection of their rights in accordance with their constitutional recognition as subjects of special protection.
The forms of territoriality and peasant organisation will be ensured, respecting both their collective and individual vision, as well as their cultural approaches, productive services and technical assistance needs.
This approach guarantees broad participation, in line with the differential approach of male and female peasants, without any kind of discrimination.
This is based on Articles 13 and 64 of the National Constitution, the Law and the jurisprudence on peasantry.

Participation scenarios.
1. Construction of the Final Peace Agreement:
the construction of the contents of the Final Peace Agreement is based on the 10 thematic axes defined in the Agreement on the Agenda.
The participation of civil society will take place on these thematic axes, through local, regional and national events, convened persons, simultaneity of the process of construction of the agreement, chronogram, coordination and logistical mechanisms.
2. Territorial transformations:
these are actions to implement Partial Agreements on identified socio-environmental needs and projects.
3. Social dialogues:
meeting spaces between members of the MDP with communities, economic, cultural, social and community organisations to address issues around a concerted agenda with the community, which allows in the short term to manage actions aimed at mitigating the situations raised.
As well as gathering elements that allow for progress in the construction of transformation agreements that require medium and long term processes.
These meetings should involve members of the territorial public entities and authorities of a public and territorial nature.
4. Inter-institutional and community commissions and other forms of coordination:
these are spaces for constructive dialogue and work in special areas, agreed between state institutions and community leaders from grassroots organisations of the territory.
The objective of the Commissions and other forms of coordination is to build, in a concerted and participatory manner, plans for Territorial Transformation for Peace in certain areas of the country in which the parties have agreed on the possibility of carrying out demonstrative actions or a pilot action project, with the facilitation of the MDP.
5. Social, citizen and community oversight for peace:
social, citizen and community oversight of the peace talks is exercised as practices of citizen control of the MDP and its mechanisms, from organisations, groups or individual actions, aimed at promoting compliance with the Agreements, Protocols and Commitments.
This social, citizen and community oversight can be carried out at the national, regional and local levels, in relation to each of the dimensions of the commitments.
Oversight can be exercised by different types of social or civil organisations and/or groups organised to influence the process led by the MDP.
The feedback or response to the contributions of the monitoring and the demand for compliance with the commitments made by the social watchdog will be carried out when pertinent in the scenarios of participation and pedagogy promoted by the MDP.
The social, citizen and community oversight will have the characteristics of autonomy in its organisation, operation, sustainability and independence with respect to the parties.
6. Social Oversight in the Oversight, Monitoring and Verification Mechanism (MVMV): in accordance with the definitions of the Peace Dialogue Table, the MVMV follows the methodologies of the standard operating procedure (PON) to interact with the Ceasefire Oversight exercised by the population, its communities and organisations, and by responding to their warnings and recommendations.
Participation methodology for the construction of the thematic Agenda of the Agreement.
In accordance with the Agreement on the Construction of the Agenda for Peace, signed in Cycle V, the following thematic axes are defined:
Axis 1. Territorial transformations and immediately applicable agreements.
Axis 2. Lands and territory.
Axis 3. Environmental peace.
Axis 4. Political issues, corruption and culture of peace.
Axis 5. Economic, labour and social issues.
Axis 6. Rights of all vulnerable populations and those of special protection.
Axis 7. Models of justice and victims' rights.
Axis 8. Conflict, security and arms.
Axis 9. Guarantees for the parties after the agreement.
Axis 10. Normative frameworks and international relations for peace.
In the process of constructing the contents of the Thematic Agenda and the Special Territorial Transformation Agreements, the following methodological guidelines will be used, in addition to observance of the agreements and protocols signed at the Roundtable:
1. Events.
The methodology for the construction of the contents of the thematic Agenda will include the development of local, regional and national events.
These may be forums, assemblies and meetings that bring together diverse knowledge systems based on the identification and nominal convocation of people, organisations, representatives of academic, productive and business sectors, public entities and centres of thought, that can contribute, complement and expand on the themes that have been previously agreed upon by the MDP.
2. Previous contributions in each theme
Written or audiovisual contributions on each of the thematic axes and sub-themes will be received at social dialogue events, thematic events and through virtual media.
These will be consolidated by the Plural Technical Secretariat and the MDP Thematic Commission.
Each delegation to the MDP will provide inputs for each theme, taking into account consultation processes and work with specialists.
All documents will be made available to interested individuals on a portal exclusively dedicated to thematic documentation, which will be managed by the Plural Technical Secretariat and the communication officers designated to the MDP by each delegation.
3. Timetable and simultaneity.
The timetable adopted for the construction of the texts of the Agreement in each thematic area assumes simultaneity in the progress of participation.
Before each event, adequate preparation must be made by providing the people, organisations and entities convened by the MDP with documentation and information to guide and facilitate the relevant contribution.
4. Special Meetings
To advance consensus building on the MDP, the following will be held:
• Special sessions or meetings with experts and consultants.
• Seminars or workshops in collaboration with guarantor and accompanying countries.
• Visits to significant experiences.
• Specialized forums with think tanks.
• Ancestral rituals of indigenous peoples.
• Spaces for diverse forms of knowledge and community practices.
5. Thematic Committee
The MDP will appoint a Thematic Committee to manage the participatory process and consolidate inputs.
This Committee, like the others foreseen in the MDP regulations, does not have the autonomy to approve Agreements and will be headed by delegates of the parties and will rely on the technical and logistical support of the Office of the Peace Commissioner Advisor.
However, it will be able to contribute to the identification and recommendation of criteria that contribute to the implementation of the Agreements in the thematic Axes.
In each Cycle and in special sessions, the MDP will consider the progress made on the issues and will record in minutes the consensus reached between the parties.
Consensus and dissenting formulations should be included here.
An agreed text is understood to be that which has the signatures of both delegations and is adopted in plenary.
Similarly, a summary will be made of the disagreements and of the activities to seek rapprochement on the key issues on which differences persist.
The information gathered in the Peace Process will be systematised by the Technical Secretariat appointed by the MDP, which will work in coordination with the Thematic Committee.
Each delegation will receive copies of this information, and the Office of the Peace Commissioner Adviser and the Accompaniers will be responsible for its safekeeping.
Methodology of participation in the Dialogues Table events.
The main purpose of the events promoted by the MDP will be the construction of the contents of the Thematic Agenda, Agreements and, in general, listening and dialogue in a pluralistic and inclusive manner with the communities, social organisations and with the participation of public entities.
In this sense, the following minimum methodological requirements are proposed:
a. Prior to each proposed event, the MDP coordinators will hold a dialogue, preferably in person, to define the precise location of the event, the topics to be addressed, the scope of the call, the number of people attending, and the time and resources needed to carry it out.
For the above, the territorial entities and authorities of the region where the event is proposed to be held should also be convened.
b. The call will be made with the criterion of representative participation and with the aim that the events have a contributive and not merely deliberative character.
To this end, the parties in the MDP will make their respective proposals of relevant actors to be invited according to their experience and previous knowledge of the area, for which they may rely on the information provided by local organisations and territorial authorities.
c. In order to guarantee ethnic, peasant, women's groups and LGBTIQ+ people's participation, the initial step will be to identify representatives of organisations, peasant, indigenous, Afro-descendant, Raizal, Rrom and Palenquero communities present in each zone.
An invitation will be issued ahead of time, thus ensuring their participation in the events and their return to their respective territories.
Delegates may be appointed by resguardos, communities, community councils, among other territorial authorities, as well as peasant reserve zones and peasant agro-food territories, to represent them at the events.
d. The topics to be addressed at each event should be communicated and detailed in advance to the invited organisations and communities, so that they have enough opportunity to prepare the necessary inputs (consolidation of proposals, communiqués and petitions).
e. The pedagogical activities consist of workshops, seminars, gatherings and other activities aimed at raising awareness and promoting a culture of peace and at pedagogically socialising the progress and achievements of the MDP, in accordance with the Protocol on Pedagogy signed at the Roundtable.
Methodology for participation in the Inter-institutional and Community Commissions, and other forms of coordination.
The MDP may set up Inter-institutional and Community Commissions, and other forms of coordination, whose mission will be to build, in a concerted and participatory manner, plans for Territorial Transformations for Peace in the agreed special zones.
Commissions and other forms of coordination may work on a regionalised basis, with local sessions.
Commissions are not a compulsory mechanism to advance in transformative actions and they will be formed based on their relevance for addressing needs.
The Commissions are made up of community spokespersons from representative peasant organisations, productive, urban and women's sectors, forms of ethnic representation and associations of community boards with territorial roots, as well as persons delegated by ministries, government agencies, technical institutes, decentralised entities, governors‘ and mayors’ offices, among others.
The Commissions and other forms of coordination will draw up their own regulation, organise their functioning, define their work plan and build, in a concerted and participatory manner, the route for addressing issues that are related to their function.
They will identify sources of funding, timetables and determine the way in which they will follow up, monitor and measure the social impact of what has been agreed.
