Description
This agreement establishes commitments from both the Colombian National Government and the armed group Southern Comuneros to protect the rights of children and adolescents in ten municipalities in Nariño department affected by armed conflict. The government, through the ICBF, commits to conducting a comprehensive characterisation of the child population's situation, while Southern Comuneros commits to refraining from conduct that endangers children's rights and to sharing risk information. A Technical Subcommittee for the Protection of Children's Rights is created to jointly design social interventions, define protection routes, and deliver a preliminary report within 90 days.

Children and adolescents who are relatives of members of the Southern Comuneros, within the framework of this group's transition to full citizenship, will be guaranteed their right to family life, as well as the full enjoyment of all their rights.

2. Commitments of Southern Comuneros

Southern Comuneros undertakes to refrain from any conduct that jeopardises the rights of children and adolescents, meaning anyone under the age of 18.

Likewise, it will promote respect for the rights of this population in the areas where it is present and will collaborate in the implementation of the routes for the comprehensive protection of their rights agreed upon in the framework of this Agreement.

The collaboration of Southern Comuneros will be subject to its capacities and the progress made in implementing the justice model, and under no circumstances will it affect the processes of transition to full citizenship.

Similarly, Southern Comuneros undertakes to provide information, within the framework of the Technical Subcommittee for the Protection of the Rights of Children and Adolescents, on situations of risk that it is aware of with regard to this population.

The confidential and extrajudicial information provided will be intended solely for comprehensive characterisation and the establishment of pathways for comprehensive protection, and to that extent may not be used for other purposes such as intelligence work or prosecution.

3. Establishment of the Technical Subcommittee for the Protection of the Rights of Children and Adolescents - ‘Subcommittee on Children’

In order to carry out a comprehensive characterisation of the population of children and adolescents for the implementation of priority routes for the comprehensive protection of their rights, a Technical Subcommittee for the Protection of the Rights of Children and Adolescents will be formed, composed of delegates from the National Government, Southern Comuneros, and the team designated by the ICBF, and open to the participation of the accompaniers of the Roundtable for Territorial Peace Co-Construction in Nariño.

The Ombudsman's Office will be invited to the Subcommittee.

The main task of the subcommittee on children will be to jointly establish the social interventions necessary to guarantee the rights of children and adolescents to a life full of opportunities and in a peaceful environment.

To this end, it will begin by conducting an assessment of opportunities and the situation of children's and adolescents' rights in the municipalities covered by this agreement and will establish this assessment as the baseline for a collective roadmap for children, from conception to the age of 18.

The subcommittee on children will define the protocols, strategies, community work methodologies, plans, and actions necessary for the development of the characterisation process, as well as the priority routes for the comprehensive protection of children and adolescents.

The subcommittee on children will invite officials, authorities, and traditional authorities of indigenous peoples, community councils, and peasant associations that it considers relevant to the fulfilment of its objectives.

The subcommittee on children will also establish specific conditions to guarantee the rights of children and adolescents who are relatives of members of the Southern Comuneros, within the framework of this group's transition to full citizenship and the right of all children and adolescents to live with their families and have their rights guaranteed.

The subcommittee on children will submit a preliminary report to the Roundtable for Territorial Peace Co-Construction within ninety (90) days of the signing of this Agreement, which will include initial findings, identified needs, and proposals for priority intervention.

Based on the preliminary report, a timeline will be defined for the characterisation, as well as differentiated routes within the framework of the comprehensive protection of the rights of children and adolescents in the identified municipalities.

The delegations of the National Government and Southern Comuneros, as well as the Episcopal Conference of Colombia, will contribute the information they have available to the process of characterising children and adolescents, in order to guarantee, protect and restore their rights.

The Roundtable for Territorial Peace Co-Construction in Nariño will monitor the functioning and development of the Subcommittee.
