Introduction

The delegations of the National Government and of Comuneros del Sur, in co-construction with the Indigenous authorities of the Gran Mallama Reservation, belonging to the Pasto people, in recognition of the advanced stage of the peace process taking place within the framework of the Roundtable for the Co-Construction of Territorial Peace in Nariño, hereby sign Agreement Number 8 for the creation of a Temporary Settlement Zone, called the “Temporary Zone for the Co-Construction of Territorial Peace,” in accordance with paragraph 3 of Article 5 of Law 2272 of 2022, which amended Article 8 of Law 1941 of 2018.

1. Purpose and Duration

The purpose of the “Temporary Zone for the Co-Construction of Territorial Peace” is to initiate the transition of the members of Comuneros del Sur towards full citizenship, which includes the commencement of the implementation of the justice model aimed at consolidating territorial transformations and the de-escalation of violence.

The Zone will allow for the laying down of arms by Comuneros del Sur.

To achieve this objective, its duration shall be one year, counted from the date of the administrative act granting it validity.

With the signing of this Agreement, within the framework of Law 2272 of 2022, it is understood that arrest warrants, including those issued for extradition purposes, against members of Comuneros del Sur who enter or are in transit to the Zone shall be suspended.

The National Government shall forward this Agreement to the competent judicial authorities for the notification of the suspension of the arrest warrants, shall undertake the necessary incorporation acts, and shall report on the progress of the implementation of the suspension.

During this process, Comuneros del Sur shall conduct itself in a manner that fully respects the authority of the El Gran Mallama Reservation, the civilian population, the protocols adopted within the framework of this Agreement, and the customs and traditions of the Pasto people.

5. Participation of the Accompanying Entities

The Mission to Support the Peace Process of the Organization of American States (MAPP-OAS), the Embassy of the Kingdom of the Netherlands, and the Episcopal Conference of Colombia shall provide accompaniment to this Agreement under the terms defined in the protocols.
