Description
A short agreement detailing the conclusions and work routes reached following discussions between the peasant communities of the northwest of the Chiribiquete Park and the institutions responsible for public policy on peasant rights, environment, lands and territorialities. The discussions and subsequent agreement are part of a wider initiative to reconcile the protection of the Amazon and recognition of peasants and their alternatives for sustainable development. As such, the agreement contains dispositions mainly centred on Land Management and Environment protection.

REPORT ON CONCLUSIONS

MEETING IN LA MACARENA TO ADVANCE IN THE TERRITORIAL TRANSFORMATIONS

CAQUETÁ, META Y GUAVIARE

14 to 16 March 2025

A meeting was held in the municipality of La Macarena, Meta, to advance in the dialogue between the peasant communities of the northwest of the Chiribiquete Park and the institutions responsible for public policy on peasant rights, environment, lands and territorialities, in an attempt to advance in the closing of the agricultural frontier for the protection of the Amazon, in harmony with the recognition of peasants and their alternatives for sustainable development.

The work carried out between community representatives, representatives of national and territorial government entities, representatives of government delegations and the Jorge Suarez Briceño Bloc of the FARC-EP.

Counted with the participation of the Ombudsman’s Office and the National Attorney General’s Office, and with the accompaniment of the UN Mission and MAPP OEA, the guarantor countries and the World Council of Churches and the National Episcopal Conference.

The following conclusions and work routes were reached.

In the context of the meeting, the communities insistently called on the parties of the Table of Dialogues and the National Government to maintain efforts to build peace through political dialogue as well as to maintain the ceasefire, put the MVMVs into operation in the area and fulfil the commitments agreed upon to advance in the territorial transformation.

1. Socio-environmental dynamics in parks (Chiribiquete).

Conduct a tour of the Chiribiquete National Park area to determine the specific situation of the communities occupying the park, using a characterisation methodology that promotes the collection of historical information on the occupation and use of the territory and allows for the construction of a work plan to advance the conclusion of agreements for the guarantee of rights and the necessary conservation measures, in accordance with the regulations set out in the document of the tripartite joint commission.

The characterisation methodology will be reviewed and approved by the tripartite commission and its working basis will be the documents produced by the national and regional roundtables of National Natural Parks - PNN, as well as others that may be contributed by the communities concerned and the competent entities.

In accordance with the requests made by the communities at the meeting, National Natural Parks will continue the information and verification visits regarding the extension of the boundaries of Chiribiquete park and in the other national parks in the area of interest that may be required by the communities.

The actions to be developed may include the following lines:

- Determine and agree on natural regeneration zones and rehabilitation models.

- Establish and recognise sustainable land uses within the framework of activities of low environmental impact and social benefit defined by the competent environmental authorities.

- Territorial environmental pact in defence of the Orinoquia and the Amazonía that promotes the good living of the communities and indigenous peoples, the environmental connectivity of strategic ecosystems, with sustainable productive models, that allow the closing of the agricultural frontier and the forest delimitation, the recovery of the transformed areas of the PNN and stop actions of deforestation.

- Land inventories and characterisation of the population to determine available territories and to conclude relocation agreements with those rural occupants in parks who request to move forward in this direction.

2. Work on Peasant Reserve Zone, ZRC, Law 160/94, Decree 1147 of 2024, Agreement 337 of 2023.

Promote and manage the organisational processes of ZRCs that have been presented in the framework of the meeting, in accordance with the legislation in force in the Zones of Interest:

I. A peasant reserve zone on the agricultural frontier of the Sábanas del Yari of the municipality of San Vicente del Caguén and La Macarena, with the organisations CORPOYARI and ASOPEPROC.

II. A peasant reserve zone in the Yarí:

in the initial phase of socialisation and delimitation of the intervention polygon in 25 rural communities represented by the organisations ASECADY, ASOAGREM and ARCASIRUR of the Sábanas del Yarí in San Vicente del Caguán.

Its territorial extension mostly includes forest reserve zone of law 2 of 1959.

III. Peasant reserve zona on the territory of the department of Guaviare by Puerto Cachicamo and the department of Meta, nearby rural communities Nucleo1, Choapal, Manaviri with ASCATRAGUA, ASGROCAMG, ASOPAS, ASOJUNTAS and ASCAGY.

IV. Peasant reserve zone of Puerto Concordia with COOAGROAMPAS

V. Peasant reserve zone in Puerto Rico with AGROGUEJAR.

Work articulated between the communities interested in the processes of constitution of the aforementioned ZRCs, the territorial entities, the Ministry of Agriculture and rural development, the Ministry of environment and sustainable development, the National Land Agency, the Agustín Codazzi Geographic Institute and the other entities that are competent for the collection of data in the territory that allows for the updating of geographic, cadastral and village information at the scales necessary for participatory planning with communities.

Through the implementation of strategies such as training schools and community training for the collection of cadastral information and other actions aimed at updating municipal and departmental land use planning.

Promote sustainable development plans for established and future ZRC, and in those where it is applicable according to the environmental zoning of the forest reserve areas under Law 2 of 1959, that include the development of productive projects in recognition of the economic and social rights of the peasantry in these territories.

3. Strategies for land management in forest reserve areas under Law 2nd (hubs, removal, regularisation of occupation and peasant forestry concessions in these areas).

Promote and sign a territorial pact or agreement to advance participatory environmental zoning in the forest reserve zones of Law 2 of 1959, which updates the permitted uses in these zones.

The tripartite joint commission will establish a work plan for the recognition of the rights of the peasants occupying the forest reserve areas of Law 2nd that seeks to improve their living conditions and their consolidation as fundamental actors in environmental protection.

The work plan will include routes based on the following alternatives agreed upon in the document on political, social, legal, and environmental and sustainable development criteria approved by the commission.

- Peasant forestry concessions for peace – Resolution 057 of 2025

- Peasant reserve zones in forest reserve areas under Law 2 of 1959:

Decree 1147 of 2024

- Forest economy and biodiversity development hubs.

- Regularisation of occupation – Agreement 315 of 2023.

- Removal of forest reserve areas

- Sustainable productive projects according to environmental zoning and legal alternatives.

4. Integrated Management District -IDM and agricultural frontier.

Advance in the titling of the nation's allocable vacant lands located in areas of interest to be handed over to landless farmers with territorial roots.

The parties to the Rountable commit themselves to provide guarantees for the institutional and community action required for the implementation of the guidelines and actions contained in each of the axes of this document, as well as for the development of the plans, programmes and projects that recognise the rights of peasants as subjects of special protection in compliance with article 64 of the Political Constitution.

5. Security and human rights

An open dialogue was held with communities on issues affecting (i) civil and political rights, related to security strategies, actions by law enforcement agencies, the handling of disciplinary and criminal cases, and the stigmatisation of signatories;

(ii) economic, social and cultural rights;

(iii) security and freedom for the action of the entities in the territory;

(iv) the role of peasant guards as JAC bodies.

The delegations of the MDP and the Joint Legal Commission will follow up on complaints in a timely and specific manner.

Similarly, the Ombudsman's Office will address specific cases through a short-term work plan.

A meeting on human rights policy is proposed with the defence sector and the Attorney General's Office, with the participation of delegates from the MDP and representatives of the communities.

It is requested that during the month of April, the wells commission report requested by the communities on the status of judicial proceedings associated with Operation Artemisa and the one carried out in Caño Yeimi be delivered, as well as other facts that may be brought to the attention of the Ombudsman's Office.

This report will be delivered to the associations attending the present meeting.

The same will be done with the PNN's response to the sanctioning proceedings.

Spokespersons for the peasant guards clarify that the peasant guard is conceived as a civil and autonomous organisation, which depends on the JACs in its task of defending human rights and the environment.

They reject being stigmatised as organisations at the service of armed groups.

The delegations to the MDP will refer to the institutions the requests made, particularly regarding the right to education, health, and the need to implement actions to comply with UN Resolution 1325, requiring a response to the demands of the populations.

It is recommended that the Ombudsman's Office issue an early warning about the critical situation of boys, girls, and adolescents.

The Table of Dialogues for Peace reaffirms its commitment to continue advancing in actions that guarantee the right to participation of all actors in the construction of peace, especially ethnic communities, peasants, women’s groups and LGBTIQ+ people in each zone.

The parties undertake to respect and guarantee human rights and call for the exercise of press freedom to be carried out within the framework of civil responsibility, pluralism, and the provision of truthful information to society.

Through the tripartite joint commission, a short-term action plan will be developed with the competent entities that responds to the conclusions set out in this document for each of the areas addressed, enabling the implementation of characterisations and intervention baselines in order to establish the necessary financing and planning instruments.

The documents submitted by the Joint Tripartite Commission, the communities and the entities are attached to the conclusions.
