CREATION OF THE TEMPORARY ZONE FOR THE “CO-CONSTRUCTION OF TERRITORIAL PEACE” IN THE MUNICIPALITY OF MALLAMA
Introduction
The delegations of the National Government and of Comuneros del Sur, in co-construction with the Indigenous authorities of the Gran Mallama Reservation, belonging to the Pasto people, in recognition of the advanced stage of the peace process taking place within the framework of the Roundtable for the Co-Construction of Territorial Peace in Nariño, hereby sign Agreement Number 8 for the creation of a Temporary Settlement Zone, called the “Temporary Zone for the Co-Construction of Territorial Peace,” in accordance with paragraph 3 of Article 5 of Law 2272 of 2022, which amended Article 8 of Law 1941 of 2018.
1. Purpose and Duration
The purpose of the “Temporary Zone for the Co-Construction of Territorial Peace” is to initiate the transition of the members of Comuneros del Sur towards full citizenship, which includes the commencement of the implementation of the justice model aimed at consolidating territorial transformations and the de-escalation of violence.
The Zone will allow for the laying down of arms by Comuneros del Sur.
To achieve this objective, its duration shall be one year, counted from the date of the administrative act granting it validity.
2. Central Role of the Pasto Indigenous People
The Pasto Indigenous People are a purposeful and decisive actor in the peace process between the National Government and Comuneros del Sur.

3.Commitments of the National Government
The National Government undertakes to guarantee, within the “Temporary Zone for the Co-Construction of Territorial Peace,” the full validity of the Social Rule of Law, the comprehensive protection of the fundamental rights of the civilian population, and effective coordination with public authorities to ensure appropriate conditions of coexistence, respect, and harmony.
With the signing of this Agreement, within the framework of Law 2272 of 2022, it is understood that arrest warrants, including those issued for extradition purposes, against members of Comuneros del Sur who enter or are in transit to the Zone shall be suspended.
The National Government shall forward this Agreement to the competent judicial authorities for the notification of the suspension of the arrest warrants, shall undertake the necessary incorporation acts, and shall report on the progress of the implementation of the suspension.
The suspension of arrest warrants shall also apply for the performance of activities related to the process outside the ZUT.
Once this Agreement is signed, the Zone shall be geographically delimited.
For reasons of security and public order, such information shall be kept confidential, in accordance with Article 6 of Law 1712 of 2014.
The implementation of this Agreement, within the framework established by Convention No. 169 of the International Labour Organization, entails the carrying out of prior consultation with the Gran Mallama Reservation.
4. Commitments of Comuneros del Sur
Comuneros del Sur shall undertake to initiate an orderly, gradual, and controlled process of relocating its accredited members within the territory demarcated for the “Temporary Zone for the Co-Construction of Territorial Peace,” in accordance with a specific protocol that shall be designed, agreed upon, and verified within the framework of the Roundtable for the Co-Construction of Territorial Peace.
During this process, Comuneros del Sur shall conduct itself in a manner that fully respects the authority of the El Gran Mallama Reservation, the civilian population, the protocols adopted within the framework of this Agreement, and the customs and traditions of the Pasto people.
5. Participation of the Accompanying Entities
The Mission to Support the Peace Process of the Organization of American States (MAPP-OAS), the Embassy of the Kingdom of the Netherlands, and the Episcopal Conference of Colombia shall provide accompaniment to this Agreement under the terms defined in the protocols.
6. Protocols
This Agreement shall be governed by the following specific protocols, whose implementation shall be jointly accompanied, monitored, and evaluated:
a. Protocol on Transit and Entry into the Zone:
This shall regulate the process of transit, entry, and gradual settlement of the members of Comuneros del Sur within the Zone, respecting the territorial, cultural, and logistical criteria previously agreed.
b. Protocol on the Functioning of the Zone:
This shall establish the conditions for the functioning of the Zone to ensure the validity of the Social Rule of Law, in harmony and coordination with the Indigenous authorities governing the El Gran Mallama Reservation, including guarantees for the civilian population and inter-institutional coordination.
This protocol shall regulate the entry and exit of the members of Comuneros del Sur to enable their participation in territorial transformations, the de-escalation of violence, and the transition towards full citizenship.
c. Protocol on the Possession of Arms until their Laying Down:
This shall regulate the gradual process of possession leading up to the laying down of arms by the members of Comuneros del Sur within the Zone.
